Welcome to KP Astro App. These Terms & Conditions (“Terms”) govern your use of the KP Astro App (the “Service”), its website at kpastroapp.com, and any related services. IMPORTANT NOTICE: ARBITRATION AND CLASS ACTION WAIVER
THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 17). THEY AFFECT YOUR LEGAL RIGHTS, INCLUDING HOW DISPUTES ARE RESOLVED. PLEASE READ THEM CAREFULLY.
1. Acceptance of These Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. You represent and warrant that you are of legal age in your jurisdiction and have the capacity to enter into this agreement.
2. Nature of the Service
The Service provides:
- Astrology Tools: Horoscope charts, planetary transits, ephemeris-based calculations, and Telugu calendar/panchang features.
- AI Insights: An AI-powered chatbot producing automated astrology interpretations and predictions.
- Paid Features: Access to premium tools via subscriptions and/or AI credits.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.
3. Disclaimers — Entertainment Only
- 3.1 Entertainment and Educational Use: The Service is provided for entertainment, educational, and informational purposes only.
- 3.2 No Professional Advice: The Service does not provide medical, mental health, legal, financial, or tax advice. Astrology is a matter of belief and interpretation; it should never substitute for professional consultation.
- 3.3 No Reliance: Any action you take based on the Service (including AI outputs) is taken strictly at your own risk. You are solely responsible for your decisions and their outcomes.
4. AI Chatbot Limitations
The chatbot generates responses using automated systems. You acknowledge that:
- Inaccuracy: AI output can be non-deterministic and may be inaccurate, incomplete, misleading, or inappropriate.
- Verification: You agree to use your own judgment and independently verify any information provided by the AI before relying on it.
- Assumption of Risk: You assume all risks arising from your use of or reliance on AI-generated content.
5. Accuracy of Calculations
Astrology calculations depend on user inputs and third-party data (e.g., ephemeris sources). Results may vary due to:
- Incorrect birth data (date, time, or location).
- Assumptions regarding Time Zones or Daylight Savings Time (DST).
- Limitations or updates in third-party libraries.
Time Convention: Unless otherwise specified in the UI, all times are provided in UTC. You are responsible for verifying the accuracy of your inputs.
6. Accounts and Security
If you create an account, you agree to provide accurate information and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contact@kpastroapp.com of any unauthorized use.
7. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, or abusive purposes.
- Attempt to bypass rate limits, access controls, or security measures.
- Scrape, crawl, or data-mine the Service without explicit permission.
- Reverse engineer the underlying models or source code.
- Use the Service to build or train a competing astrology or AI product.
8. Intellectual Property
The Service, including its software, design, text, logos, and "look and feel," is owned by us or our licensors. We grant you a limited, non-exclusive, revocable license for personal, non-commercial use only.
9. User Content and Privacy
- 9.1 Ownership: You retain ownership of data you provide (birth details, chat messages, etc.).
- 9.2 License: By submitting content, you grant us a worldwide, royalty-free license to host, process, and display your data solely to operate and improve the Service and comply with legal obligations.
- 9.3 Privacy: Our data practices are governed by our [Privacy Policy].
- 9.4 Third-Party Processing: We use third-party providers (e.g., Stripe, Razorpay, AI model providers). Your AI queries may be processed by third-party AI systems. We do not send personally identifiable information to these providers unless it is included in your chat text or required for the Service.
10. Payments and AI Credits
- 10.1 Payment Processors: Payments are handled by Stripe and/or Razorpay. Purchases are subject to their respective terms.
- 10.2 AI Credits: Credits have no cash value, are non-transferable, and are not redeemable for cash. They do not expire unless required by law.
- 10.3 Pricing: We may change prices or credit usage rates at any time. Changes apply prospectively.
- 10.4 Refunds: Refunds are provided at our sole discretion (e.g., for duplicate charges or technical failures) unless otherwise required by law.
11. Service Availability and Liability
- 11.1 "As Is" Basis: The Service is provided "AS IS" and "AS AVAILABLE." We do not guarantee 100% uptime.
- 11.2 Limitation of Liability: To the maximum extent permitted by law, our total liability for any claim shall not exceed the greater of:
The amount you paid us in the three (3) months preceding the claim; or
USD $50.00.
- 11.3 Indirect Damages: We are not liable for any indirect, incidental, or consequential damages (such as loss of profits or data).
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Binding Arbitration and Class Action Waiver
- 13.1 Agreement to Arbitrate: You and we agree that any dispute arising out of or relating to these Terms will be resolved by binding arbitration, not in court, except as provided below.
- 13.2 Exceptions: Either party may bring an individual action in small claims court. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access (scraping/hacking).
- 13.3 Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- 13.4 Format: Arbitration may be conducted by video, phone, or written submission if you are outside the U.S. or unable to travel.
- 13.5 Class Action Waiver: ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.
- 13.6 Opt-Out: You may opt out by emailing contact@kpastroapp.com with the subject "Arbitration Opt-Out" within 14 days of your first use of the Service. Include your full name and account email.
14. Governing Law and Venue
These Terms are governed by the laws of the State of California, USA. For any court proceedings permitted under these Terms, the parties consent to the exclusive jurisdiction of the courts in San Francisco County, California.
15. Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
